By analyzing legal precedents, such as Thaler v. US Copyright Office, and the broader implications of generative AI platforms, it explores how current laws fail to address the complexities of machine-created works. The paper explores the societal and philosophical impact of AI art and provide insights for policymakers, artists, and technologists as they navigate this evolving landscape.<\/jats:p>\n<\/jats:sec>\n<jats:sec>\n<jats:title content-type=\"abstract-subheading\">Design\/methodology\/approach<\/jats:title>\n<jats:p>The design adopted in this paper is content review.<\/jats:p>\n<\/jats:sec>\n<jats:sec>\n<jats:title content-type=\"abstract-subheading\">Findings<\/jats:title>\n<jats:p>The paper identifies significant gaps in copyright law regarding AI-generated art, particularly around the Human Authorship Requirement.
