Law Rev."],"published-print":{"date-parts":[[2019,4,1]]},"abstract":"<jats:p>This article uses the legal construct \u2018joint criminal enterprise\u2019 (<jats:sc>jce<\/jats:sc>) as a focal point of the tensions between international criminal law (<jats:sc>icl<\/jats:sc>) and common criminal law. Drawing on the assumption that an over-arching concept of the criminal law <jats:italic>in genere<\/jats:italic> is plausible, and that <jats:sc>icl<\/jats:sc> is a special branch stemming therefrom, the authors start by characterising <jats:sc>jce<\/jats:sc> and by assessing the possible incompatibility of some of its forms with the principles of legality, voluntary act and guilt. The authors then question whether <jats:sc>jce<\/jats:sc> could be validated under a different understanding of <jats:sc>icl<\/jats:sc> (as an autonomous legal branch, or, at least, as a special branch within criminal law abiding by different principles).
