In this paper, we construct such a degree <jats:bold>d<\/jats:bold>, with all the r.e. degrees not cupping <jats:bold>d<\/jats:bold> to <jats:bold>0<\/jats:bold>\u2032 bounded by some r.e. degree strictly below <jats:bold>d<\/jats:bold>.
