Ciencia Ens."],"abstract":"<jats:p>Resumo Neste trabalho faz-se uma ana\u0301lise da Historia da evoluc\u0327a\u0303o da regulamentac\u0327a\u0303o de protec\u0327a\u0303o ambiental relativa a\u0300 gesta\u0303o de efluentes e resi\u0301duos vitivini\u0301colas nas ultimas 3 de\u0301cadas (apo\u0301s a adesa\u0303o de Portugal a\u0300 enta\u0303o CEE). Ha\u0301 ja\u0301 alguns se\u0301culos que se percebeu a importa\u0302ncia da preservac\u0327a\u0303o da fauna e da flora do meio ambiente para a nossa sobrevive\u0302ncia e para a manutenc\u0327a\u0303o do planeta terra em condic\u0327o\u0303es de permitir a sobrevive\u0302ncia das gerac\u0327o\u0303es vindouras (desenvolvimento sustenta\u0301vel, hoje em dia falamos de economia circular). Contudo, nos pai\u0301ses industrializados da europa, a regulamentac\u0327a\u0303o ocorreu principalmente nas u\u0301ltimas 3-4 de\u0301cadas, integrando de maneira crescente a preocupac\u0327a\u0303o ambiental, e evoluindo gradualmente de uma mera preocupac\u0327a\u0303o com o processo te\u0301cnico de tratamento de efluentes e resi\u0301duos, para uma perspetiva mais global de economia sustenta\u0301vel. De forma lo\u0301gica, a preocupac\u0327a\u0303o dos legisladores comec\u0327ou primeiro pelo despejo de efluentes e resi\u0301duos industrias perigosos\/to\u0301xicos, estendendo-se progressivamente aos restantes resi\u0301duos e efluentes humanos, agroindu\u0301strias e agri\u0301colas. E\u0301 normalmente a legislac\u0327a\u0303o da unia\u0303o europeia que serve de baro\u0301metro, sendo transposta a\u0300 posteriori e regularmente (algumas vezes alguns anos depois) para a legislac\u0327a\u0303o dos diversos pai\u0301ses membros, nas mais diversas a\u0301reas. Esta legislac\u0327a\u0303o aborda frequentemente a fileira completa da mate\u0301ria prima, aos produtos e efluentes, incluindo a gesta\u0303o dos resi\u0301duos, a reutilizac\u0327a\u0303o dos materiais, a protec\u0327a\u0303o das a\u0301guas, as condic\u0327o\u0303es de utilizac\u0327a\u0303o das lamas de ETARs e a luta contra a poluic\u0327a\u0303o por nitratos. Estas Diretivas da UE sa\u0303o, pois, a base dos textos que cada um dos estados membros devera\u0303o transpor em devido tempo. Palavras-chave: Legislac\u0327a\u0303o; adega, ambiente; historia da cie\u0302ncia, Portugal Abstract In this article we analyse the history and the evolution of the environmental protection regulations related to the Winery effluents and wastes management in the last 3 decades (after Portugal's accession to the EEC).For some centuries we have realized the importance of preserving the environmental fauna and flora for our survival and for maintaining f the planet earth in good conditions to allow the survival of future generations (sustainable development, nowadays we speak in circular economy).However, in industrialized European countries, regulation has occurred mainly in the last 3-4 decades, increasingly integrating environmental concerns, and gradually evolving from a mere concern with the technical process of wastewater treatment to a more global perspective of sustainable economy. Understandably, the concern of legislators first began by management of effluents and wastes from hazardous\/toxic industries, progressively extending to others such as human, agro-industrial and agricultural wastes.Usually the legislation from the European Union serves as a guide, being transposed posteriorly and regularly (sometimes a few years later) into the legislation of the several countries members of the EU, in the most diverse areas. This legislation often comprises the full range of the area, from raw materials, products and effluents, including waste management, reuse of materials, water protection, conditions for the use of sludge from wastewater treatment plants and the fight against nitrate pollution. These EU Directives are therefore the basis of the texts that each member state should have transpose as soon as they can.
