What is more, it is often considered as the limitation of what can be formalized in law, which might have serious implications for the future of computational law. In this paper, we introduce a deontic logic extended with nuanced permissions pursuing to grasp the characteristics, normative framework of and reasoning process in the discretionary decision-making of the judge. We illustrate the modeling capacity of the Discretionary Judicial Decision Logic (DJDL) by formalizing examples from an area of law where discretion plays an openly crucial role: family law, more precisely child custody cases.<\/jats:p>","DOI":"10.3233\/faia241233","type":"book-chapter","created":{"date-parts":[[2024,12,6]],"date-time":"2024-12-06T00:00:29Z","timestamp":1733443229000},"source":"Crossref","is-referenced-by-count":2,"title":["Modeling Judicial Discretion with Nuanced Permissions"],"prefix":"10.3233","author":[{"given":"Josephine","family":"Dik","sequence":"first","affiliation":[{"name":"TU Wien, Vienna, Austria"}]},{"given":"R\u00e9ka","family":"Markovich","sequence":"additional","affiliation":[{"name":"University of Luxembourg, Luxembourg"}]}],"member":"7437","container-title":["Frontiers in Artificial Intelligence and Applications","Legal Knowledge and Information Systems"],"original-title":[],"link":[{"URL":"https:\/\/ebooks.iospress.nl\/pdf\/doi\/10.3233\/FAIA241233","content-type":"unspecified","content-version":"vor","intended-application":"similarity-checking"}],"deposited":{"date-parts":[[2024,12,6]],"date-time":"2024-12-06T00:00:29Z","timestamp":1733443229000},"score":1,"resource":{"primary":{"URL":"https:\/\/ebooks.iospress.nl\/doi\/10.3233\/FAIA241233"}},"subtitle":[],"short-title":[],"issued":{"date-parts":[[2024,12,5]]},"ISBN":["9781643685625"],"references-count":0,"URL":"https:\/\/doi.org\/10.3233\/faia241233","relation":{},"ISSN":["0922-6389","1879-8314"],"issn-type":[{"value":"0922-6389","type":"print"},{"value":"1879-8314","type":"electronic"}],"subject":[],"published":{"date-parts":[[2024,12,5]]}}}
