Islamic criminal offenses are divided into three categories: (1) offenses and punishments fixed in the Qur\u02bean or Sunna (hudud); (2) offenses against the person, including intentional injury and homicide, which are considered matters to be settled between the offender and victim, and for which remedies include retaliation (qisas) and financial compensation (diya); and (3) Offenses not fixed in the Qur\u02bean or Sunna, for which punishments are discretionary (ta\u02bfzir). Islamic criminal law is not applied uniformly in all locations\u2014interpretations of Sharia and hudud punishments in countries such as Indonesia and Saudi Arabia, for example, can be very different. In Pakistan, hudud offenses have been incorporated into state legislation. While Western scholarly study of Islamic law began in earnest during the era of Orientalist scholarship (late 19th through mid-20th centuries), focusing largely on questions of origins and mechanics, particularly outlining rules and regulations and the rights and duties of various groups of people, the application of women and gender methodologies to Islamic law dates to the 1980s, with substantial work beginning in the 1990s. The ILS category offers an efficient and clear-cut conceptual vehicle for mapping out the balance between religious law and secular law, and how this balance translates into ILS\u2019 preferences with respect to international conflict management venues. The chapter explains how the ILS category differs from other seemingly parallel concepts or definitions present in the scholarship, such as \u201cIslamic states,\u201d or \u201cMuslim states.\u201d It discusses the characteristics and internal variation within the ILS category across different countries and different schools of Islamic jurisprudence. This chapter also presents an analysis of ILS\u2019 domestic legal systems, elaborating on Islamic constitutionalism, and the relationship between religious norms and secular norms in constitutions and sub-constitutional legal systems. Today, this continent contains some of the most predominantly Muslim states in the world (in North Africa and the Sahara), some where Muslims are a small minority (in eastern and southern Africa), and some where there are substantial populations of both Muslims and Christians (in West Africa, notably in Nigeria). Over the course of history, since the arrival of Islam in Africa in the 7th century, there have been many changes shaping how Islamic law is applied. Islamic law affected not only relations within Muslim communities, but also the relations of Muslims with non-Muslims\u2014Christians and Jews around the Mediterranean, and people following traditional religions south of the Sahara, and in East Africa. Islamic law has provided a basis for conflict and efforts at subjugation of non-Muslims as slaves or concubines, but it has also offered a framework for negotiation, peaceful interaction, and conflict resolution. While the best-known aspect of Islamic law lies in the area of family matters\u2014marriage, divorce, and inheritance\u2014Islamic legists have played an important role in developing fiqh, or jurisprudence based on Islamic principles but adapted to local situations, dealing with such areas as water rights, commercial relations, medical practice, and cultural expression. The application of Islamic law was in many cases restricted by colonial rule from the early 19th century to the mid-20th century. Starting in the 1980s, there have been some dramatic efforts to restore the authority of Islamic courts over a wider domain of law, notably in Sudan, where such efforts led to the breaking up of the country between the predominantly Islamic north, and South Sudan, which has a religiously diverse population. In northern Nigeria, state governments restored a wide application of Islamic law, but pragmatic approaches by traditional leaders have helped preserve stability in much of the country, except in the After defining the terms \u201claw\u201d and \u201ctheology,\u201d this article offers three historiographical approaches to the subject, namely: \u201cOrientalist,\u201d \u201cRevisionist,\u201d and \u201cPragmatist\u201d, each reflecting assumptions about the function of Islamic law in Muslim communities. Orientalists are skeptical of Islamic religious texts, and argue that Islamic law and theology are unconnected, static sciences that have little to offer modern Muslims. Revisionists re-read Islamic sources to suggest that Islamic law was once a theological enterprise that devolved into legalism, but that it can be revived by returning to theology. How does the industry\u2019s Islamicity compare to the notions of trade and commerce in classical shar\u012b\u02bfa? In this essay, I explore the genealogy of Islamic finance by scrutinizing twentieth-century <jats:italic>fatw\u0101<\/jats:italic>s on share certificates. I argue that these <jats:italic>fatw\u0101<\/jats:italic>s gave rise to shareholding as a novel property relation, one that severs the shareholder\u2019s non-financial interest in the company\u2019s property. Twentieth-century <jats:italic>muft\u012b<\/jats:italic>s unanimously accepted the legitimacy of shareholding, which, in turn, contributed to the rise of the Islamic investor: a profit-maximizing, socially-disinterested homo economicus whose ethical conduct is validated in reference to modern Islamic law. The unanimous acceptance of shareholding and the investor contributed to the consolidation of the central institutions of Islamic finance: Islamic banks and joint-stock companies. It also contributed to the thinning of Islamicity. It comprises fifty-seven full member states, representing one-quarter of the global population, and it is the only international organization whose unifying feature is its religious and Islamic identity. As such, it represents an anomaly in international relations and largely explains why the organization has not figured in the majority of mainstream publications on international law until relatively recently. Established in the wake of universal Muslim outrage following the burning of the Al-Aqsa Mosque in 1969, the OIC has provided a political platform for predominantly Muslim states to promote \u201cIslamic solidarity.\u201d But it has also provided a forum to develop consensual positions on many international matters\u2014from international trade and the development of Islamic banking and halal food networks to peace and security, hate speech, and the protection of Muslim minorities. The OIC now forms a considerable bloc of countries at the UN and, with the presence of both Russia and China as observers, it has capacity to wield considerable influence on the world stage and to co-sponsor common agendas. For much of its existence, however, the OIC has been a peripheral grouping and a marginal player. Although it has forty-eight subsidiary and specialized organs, the organization itself is often dismissed as a talking shop and is without any enforcement legal machinery. No committee is endowed with powers to mirror the UN\u2019s Security Council nor has the OIC established any legal body to issue binding legal rulings on member states. The International Islamic Court of Justice, the intended Islamic World Court, seated in Jerusalem, has never operated and even its statute is yet to be ratified by the required two-thirds of OIC members. In spite of its known weaknesses and historical failures, under the leadership of its current and previous secretary-general, the OIC has sprung to life. Since arming itself with a new \u201cfit for purpose\u201d Charter in 2008, the OIC has shown a greater willingness to engage in key areas of international law, including humanitarian law, peace-making, human rights, international terrorism, and, more recently, environmental protection and climate change.
